A bill to be entitled

An act related to the legalization and regulation of marijuana in the state of Texas. This will permit a person 21 years of age or older to be allowed to have a limited amount of marijuana in his possession. With the legalization of marijuana, a tax will be implied to the whole sale of hemp. This money can then be used on our public schools.

 

Be it enacted by the Texas Model Legislature:

 

Section 1. Personal use and regulation of marijuana

  1. The people of the state of Texas find and declare that marijuana will no longer be illegal for someone 21 years or older and taxed similar to beer.
  2. In concern of public and health safety the people of Texas find and declare that marijuana should be regulated similar to beer.
  3. Individual have to show identification to show proof of age.
  4. It shall remain illegal to sell to minors under the age of 21
  5. Driving under the influence shall remain illegal

Sec. 49.02.  PUBLIC INTOXICATION.  (a) A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.

(a-1)  For the purposes of this section, a premises licensed or permitted under the Alcoholic Beverage Code is a public place.

(b)  It is a defense to prosecution under this section that the alcohol or other substance was administered for therapeutic purposes and as a part of the person’s professional medical treatment by a licensed physician.

(c)  Except as provided by Subsection (e), an offense under this section is a Class C misdemeanor.

TITLE 6. FOOD, DRUGS, ALCOHOL, AND HAZARDOUS SUBSTANCES

SUBTITLE B. ALCOHOL AND SUBSTANCE ABUSE PROGRAMS

CHAPTER 465. LOCAL DRUG AND ALCOHOL EDUCATION PROGRAMS

 

Sec. 465.001.  COMMISSION. A municipality or county may create and support with public funds a commission to:

(1)  educate the public on drug and alcohol abuse;

(2)  promote drug and alcohol education at all levels of the schools;

(3)  study the effectiveness of efforts, including the commission’s efforts, in reducing drug and alcohol abuse;  and

(4)  create and administer a program to counsel or treat drug and alcohol abusers or to provide both counseling and treatment.

 

Summary : If this bill is passed the people of Texas will have the freedom to consume cannabis safely regulated by the state of Texas. There will be a tax enforced on this bill this tax will then help our education system.
