First, you must find a “negligence” lawsuit that you think is particularly ridiculous or outrageous. For example, some consider the lawsuit against McDonald’s for having overly hot coffee to be ridiculous or outrageous. You should be conducting internet research to find your negligence lawsuit and you cannot use the McDonald’s case. Your negligence case can be one that is currently on-going or has already come to a conclusion. If the case you found settled but the terms of the settlement are not disclosed, please mention that in your paper.
Second, once you have found your negligence case, please provide a detailed description of the case including who the plaintiff is, who the defendant is, what all of the facts are surrounding the case, and what the plaintiff is/was seeking from the defendant. Important – for this section, you CANNOT just cut and paste from an article or other document. Your description MUST be in your own words while citing resources.
Third, please discuss in detail why you think your negligence case is particularly ridiculous or outrageous.
Fourth, if you were the judge in the case, how would you decide the case and why? (if your case has already been decided, discuss whether you agree or disagree with the decision and why and what you would have done differently).
Fifth, discuss whether you believe that plaintiffs who file ridiculous or outrageous lawsuits should be sanctioned in some way and if so, who would determine whether the lawsuit qualifies as “ridiculous or outrageous” and what should the sanction be?
Additional instructions:
Your paper must be a minimum of 3 pages. This means 3 FULL pages. If your paper is not exactly at least 3 FULL pages you will lose points. Given the amount of requirements in the assignment instructions above, your paper will likely exceed the 3 full pages requirements in order to fully and effectively answer everything.
Your paper must be double spaced
Your paper must be 12 point font
Your paper must have 1 inch margins
Your paper must provide a reference page at the end for all of your sources. You do not have to follow any particular style for your reference page; it should just be done clearly so that I can find your references while reviewing your paper. The reference page is an additional page and is not included in your minimum 3 full pages.
Do not include a cover sheet, title or a header that identifies your name, my name, the date or the class. You will lose points if you include this in your paper.
