One of those classes is an aerobic step class in which patrons do various routines to rhythmic music. The routines are put together by instructors for the class. Joe Newby, a new member who was admittedly out of shape and needed to join the club on the advice of his doctor, decided to take the class. The class was titled “moderate workout” level. Joe is 50 years old and had never taken a class like this. He clearly had trouble keeping up with the music and was off balance. The instructor said nothing. He took the class again two days later, with the same problems. However, in this class he fell off the step and broke his ankle. Please review and respond to the following questions in a 2-3 page paper utilizing information gleaned from the Introduction to Sport Law text, the course materials and other materials you find through researching tort law.
- Was any potential tort committed? If so, which one? Describe the requirements for proving the tort.
- Research the appropriate certification requirements for aerobics instructors. Are the certification requirements governmental, or are they used by private organizations? Do all health clubs have to hire certified instructors?
- Was the instructor liable if he or she was certified? If not? Does it matter?
- Can the health club be liable if the instructor was certified? If not
- Assume that Joe signed a waiver with the following language: “Participation in exercise involves certain inherent risks. I agree that I will assume all risks of harm arising from any exercise activity I undertake at the HighTone Health Club and hold the club free from any responsibility of any actions they take.”
