Case Analysis: Oracle v Google
1. Review the readings and videos from 2.1, 2.2, and 2.3.
2. Read Oracle v. Google (Links to an external site.)by Parloff.
3. Conduct further research of the case and use the IRAC method to conduct a case analysis.
4. State the Issue
o What is the legal question that, when answered, determines the legal result of the case? What are the parties disputing and what do they want the court to decide?
o The issue should be stated in the form of a question in a specific, rather than a general form.
o If there is more than one issue to address, then you must write a separate IRAC analysis for each issue.
5. Identify the Rule
o What law or test applies to the issue?
o The rule should be stated as a general principle and not a conclusion to the particular case.
6. Conduct an Analysis
o Apply the rule to the facts of the case. What are the relevant facts given the rule of the law?
o Use the facts to explain how the rule leads to the conclusion. How does the court interpret the rule?
o Discuss both sides to the case.
7. State the Conclusion
o The conclusion should be stated in one or two sentences. The rationale should not be longer than a paragraph.
o Do you agree with the court’s rulings thus far? Explain your answer.
8. Answer the following questions.
o If you were the judge in this case, how would you rule? Provide the rationale for your answer.
o What makes this case significant?
In addition to the above instructions, I have other instructions as well:
