The paper needs to be written from Employee’s position.
The ethical dilemma will present a legal dilemma and will require you to analyze the facts of the case and your position and to compare and contrast them with the legal cases that are attached to support or rebut the employee’s position. I want you to prepare a formal paper articulating Employee’s position and the support for it. You should not commit the No-Nos on my list in this paper. You are essentially the legal team for the employee’s position which you will be assigned.
The ideal paper will be organized accordingly: 1) statement of facts and issue, 2) public policy analysis, 3) legal analysis, and 4) conclusion. In the statement of facts, you should summarize the facts favorable to Employee position and tell me what the statement of the issue is. This section should be less than a page long. The public policy analysis section will frame the public policy issues that exist in the ethical dilemma: this will require you to examine things from a public interest point of view and to provide perspective on the socioeconomic and political forces behind your position.
The most difficult section is the legal analysis section. This section will require you to analyze the cases and compare or contrast them with your position. Your paper will be best written if you can anticipate the arguments made by the opposing side and rebut them. You would want to use the law found in the legal cases and the facts in each case. The goal would be to compare your clients to the employees in the cases which support your position and contrast them to the employees in the cases which hurt your position. This is what courts and lawyers do all the time: find support in existing case law to apply or distinguish a particular set of facts. This means that you will have to be well-versed in the cases which help you and hurt you. Your job is to convince me that I should side with your client and have something legal to base that decision on. Your paper should give me a reason to follow the law this way or that way.
